Is Using NaxLex Cheating?

Where ordinary study help ends and cheating begins, and what the NaxLex case means for students who used it.

Updated October 2026 · 13 questions answered

Short answer

It depends what you used. Practising with ordinary questions isn't cheating, but studying from content copied from secure exams can break school and ATI rules, and paying someone to sit your exam is cheating.

Study help vs cheating: where the line is

How schools and testing companies generally see each kind of prep
What you didIs it cheating?Why
Practised with original questions written to the exam blueprintNoThis is ordinary test prep, the same as using a textbook or review course.
Studied from content copied from secure examsRiskyTesting companies' terms and many schools' honour codes forbid using or sharing confidential exam content.
Paid someone to take your exam for youYesThis is the "proxy test-taking" at the centre of the fraud claim, and a serious academic-integrity violation.

Not legal advice

This page explains the case and general academic-integrity rules. Your school's own policy decides how it treats a case. If you're worried about your situation, speak privately with a trusted faculty adviser or a lawyer.

Is using NaxLex cheating?

The core questions, answered directly.

Is using NaxLex cheating?

It depends what you used. Practising with ordinary questions is not cheating. Studying from content copied from secure ATI or HESI exams can break school and testing-company rules. Paying someone to sit your exam is cheating, and is what the lawsuit calls proxy test-taking.

Is it illegal to use NaxLex?

The lawsuit is a civil case against the people who ran NaxLex, not against students. Whether a student's use broke any rules depends on what they used and their school's policies, and is a question for a qualified adviser rather than a general guide.

Were NaxLex questions real exam questions?

That is what Elsevier and ATI allege. They say NaxLex reproduced and sold copies of their registered, copyrighted assessment content and built test banks from it. The judge found them likely to succeed on that claim, but it has not been proven at trial.

Is it cheating to use other question banks?

No. Using a question bank with original, blueprint-aligned questions and rationales is normal exam prep. The problem is content copied from secure exams, or anyone offering to take or rig the exam for you.

What is proxy test-taking, and is it cheating?

Proxy test-taking is when a paid stand-in sits your exam in your name, often by logging into a remote proctored session. Yes, it is cheating, and in the NaxLex case it is the basis of the fraud claim.

Could using NaxLex affect your record?

Will my school find out I used NaxLex?

No one can say for certain. The court allowed Elsevier and ATI to subpoena NaxLex's sales records, including each buyer's city and state. The lawsuit targets the operators, not students, and buying a study subscription is very different from using the proxy service.

Can ATI or HESI tell if I studied leaked questions?

Testing companies use several layers of protection. Elsevier says every HESI question is now watermarked, 40% of exit-exam items rotate three times a year, and a security team monitors the internet for leaked content. Memorised leaked answers also go stale quickly.

Could using NaxLex affect my nursing license?

For a student who only bought a study subscription, this is unlikely to come up. Serious academic-integrity findings, such as using a proxy test-taker, can lead to dismissal and, in some cases, be reported to a state board of nursing.

What if I used the NaxLex proxy test-taking service?

That is a serious academic-integrity matter. Don't wait to be contacted: speak privately with a trusted faculty adviser or a lawyer about your options, and don't use any similar service again.

What should I say if my school asks about NaxLex?

Be honest and calm. If you only bought a study subscription, say so. If your situation is more serious, get advice from a faculty adviser or a lawyer before responding in writing.

Can I keep using NaxLex PDFs I downloaded?

It's best to stop. The court order concerns the copying and distribution of copyrighted exam content, so downloaded NaxLex material may be part of the dispute. Don't share it, and switch to original practice materials.
